In further action to alleviate the housing crisis, the State of California approved Senate Bill 9(SB9) in 2021 that went into effect in 2022. SB9 offers several key ordinances to encourage in-fill residential development. It allows A.) add an additional dwelling to the existing lot zoned for single family and B.) allow to split the lot. At a minimum, it will allow a single-family zoned lot to go from one dwelling to a total of four.
SB9 At-a-Glance
The following are the principal conditions of SB9. These are state-wide mandates that take precedence over local municipalities. Local municipalities cannot make it more restrictive. Local municipalities can expand the ordinances to encourage allowance of SB9
- Only in urban areas
- Not allowed in areas zoned for High-fire areas
- Noted allowed in 100-year flood zones
- Not allowed in hazardous areas
- Not allowed in historical zones
- Lot split minimum is 40/60
